What we collect, why, and your rights.

FUPstudio operates this store and website, and the FUPstudio design app at app.fupstudio.com, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience and our design tools (the "Services"). Our store at www.fupstudio.com is powered by Shopify, which enables us to provide the store to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described in this Privacy Policy.
Personal Information We Collect or Process
When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:
- Contact details including your name, address, billing address, shipping address, phone number, and email address.
- Financial information including credit card, debit card, and financial account numbers, payment card information, financial account information, transaction details, form of payment, payment confirmation and other payment details.
- Account information including your username, password, security questions, preferences and settings.
- Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel and your past transactions.
- Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry.
- Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
- Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.
- Content you create in the app including the words you type (prompts, requests, notes and messages to our assistant), the images you upload or attach (such as sketches, photos, logos, fabrics and references, including photos of people if you upload them), your brand details, and the designs, images and tech packs generated for you.
- Notes of the design assistant, if its memory is on for you: see "The Design Assistant's Memory" below.
Personal Information Sources
We may collect personal information from the following sources:
- Directly from you including when you create an account, visit or use the Services, communicate with us, or otherwise provide us with your personal information;
- Automatically through the Services including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies;
- From Google if you sign in with Google, which shares your name, email address and profile picture with us;
- From our store when you buy there: Shopify sends the app your email address and the items you bought, so that your purchase appears in your app account;
- From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf;
- From our partners or other third parties.
How We Use Your Personal Information
Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:
- Generating Your Designs. We use the words, images and references you give us, and the design you are working on, to understand your request and to generate the images, texts and tech packs you ask for, with the help of the AI providers described in "AI Processing in the App".
- Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services.
- Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services.
- Security and Fraud Prevention. We use your personal information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else.
- Communicating with You. We use your personal information to provide you with customer support, to be responsive to you, to provide effective services to you and to maintain our business relationship with you.
- Legal Reasons. We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.
AI Processing in the App
The app generates images and documents with AI models run by our service providers. When you use it, the content needed for your request is sent to them and processed on our behalf:
- OpenAI generates and edits images, and reads and writes text: it receives your prompt, the images you upload or attach (sketches, photos, logos, fabrics, references and photos of people), the design you are working on, the notes you write for a tech pack, and your messages to our support assistant.
- Anthropic (Claude) is the backup of the design assistant described below: when OpenAI cannot answer, the same request is sent to Anthropic.
- Replicate runs specific image steps: enlarging an image (Upscale), removing a background, and drawing seamless repeat patterns. It receives the image being processed or, for a seamless pattern, your prompt.
We do not add your name, email address or account ID to these requests. The providers receive the content of the request, including anything personal you write in it or show in an image.
The design assistant. When you generate, an AI model reads your words, the images you attach (with their file names) and the design on screen, works out what you are asking for, and writes the instruction for the image engine. It runs on OpenAI. If OpenAI returns an error, refuses, gives an answer that cannot be used or does not answer in time, the same request goes to Anthropic. We keep a record of each reading, including your words, for 30 days. The words of each request and the instruction written for the image engine are also kept with the record of that generation in your account.
Avatars from a photo. If you create an avatar from a photo, the photo is sent to OpenAI to create the avatar, and an AI model describes the visible features of the person (apparent sex, age, ethnicity, build, eye and hair colour) to fill in the avatar's casting card. Please upload a photo of a person only if they have agreed.
What the providers do with it. OpenAI states that data sent to its API “is not used to train or improve OpenAI models (unless you explicitly opt in to share data with us)” and that its abuse monitoring logs are “retained for up to 30 days, unless longer retention is required by law” (OpenAI, Data controls in the OpenAI platform). Anthropic states: “By default, we will not use your inputs or outputs from our commercial products (e.g. Claude for Work, Anthropic API, Claude Gov, etc.) to train our models” (Anthropic, Is my data used for model training?), and that for API users it deletes inputs and outputs “within 30 days of receipt or generation”, with exceptions such as content flagged for violating its Usage Policy, which it keeps for up to 2 years (Anthropic, How long do you store my organization's data?).
The Design Assistant's Memory
The design assistant can keep short notes to understand your next requests better. This section applies when memory is available for your account and switched on. When it is, the assistant may keep:
- facts about your brand that you state or type, such as your brand name, your logo, your market (menswear or womenswear) and your usual lettering;
- preferences you state or repeat, such as embroidery rather than print, or colours to avoid;
- for each garment, what you asked to keep or to remove, approaches you turned down, standing instructions for that piece, choices that could become a habit, a short summary of the garment, and your last requests on it (up to ten, shortened).
The notes are meant to be about your brand and your work, not about you as a person. The assistant is instructed never to note anything about you as a person (such as your age, appearance, origin, health or beliefs), about people shown in images, or about other people, and an automatic check discards notes, and the words of requests, in which it recognises details of this kind. The notes are used only to answer your requests in the app. They are not used for marketing, emails or advertising, they are not sent to our analytics or advertising partners, and they are not sold. During a request they are sent, together with your saved logo when it is needed, to our AI providers (OpenAI, and Anthropic as a backup) as described above.
In Settings › What FUPstudio remembers you can switch memory on or off, see and correct your notes, add a note, delete a note, forget a garment's notes, forget everything, and download your notes (the download contains everything we keep, including the full garment summaries and all recent requests). Each garment's notes are also shown on its page in My Area. Switching memory off stops the assistant from writing new notes and from using the existing ones. A logo you choose in the Tech Pack room is still saved to your account for your tech packs. If your brand details were saved only in one browser before, we ask before moving them to your account. You can also ask us by email to see or delete your notes.
A garment's notes are deleted automatically 180 days after they were last updated, and when none of that garment's designs are left. Other notes are deleted 12 months after the assistant last used them (or, if it never used them, after they were last updated); notes you typed or edited yourself stay until you delete them. All notes are deleted when your account is deleted.
We rely on the performance of our contract with you to read your requests, and on our legitimate interest in understanding your requests better to keep these notes; you can object at any time by switching memory off.
How We Disclose Personal Information
In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:
- With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).
- With business and marketing partners to provide marketing services and advertise to you. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites.
- When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
- With our affiliates or otherwise within our corporate group.
- In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.
Service Providers We Use
These companies process personal information on our behalf to run the Services. What each one receives:
- Vercel hosts the app on servers in Ireland and counts page views with Vercel Web Analytics, which does not use cookies. It receives your requests to the app, including your IP address.
- Supabase provides sign-in, the database and file storage for the app, hosted in Ireland. It stores your account, the content you create, your billing details and, if memory is on, the assistant's notes.
- OpenAI, Anthropic and Replicate provide AI processing, as described in "AI Processing in the App".
- Stripe processes payments for plans and credits. It receives your email address, name, billing address and VAT number, the payment details you enter directly with Stripe, your account ID, what you buy and, when present, the Google Analytics, Meta and TikTok identifiers used to report the purchase.
- Shopify runs the store, its checkout and your store orders, and protects the store's forms with hCaptcha. The app reads your store orders, by your email address, to show them in your account; if you are signed in to the store, the store passes your email address and customer ID to the app to sign you in.
- Google provides sign-in with Google, Google Analytics and, in the store, Google Ads and Merchant Center tags (see "Cookies and Similar Technologies").
- Microsoft provides Clarity screen recordings in the app and in the store, and Microsoft Advertising in the store, if you allow them.
- Meta, TikTok and Pinterest measure advertising, if you allow it (Pinterest in the store only).
- Klaviyo sends our newsletter. If you subscribe, it receives your email address. We also check with Klaviyo whether an account's email address is subscribed, for example before sending an offer. In the store, Klaviyo also measures visits, if you allow it.
- Resend sends the app's account and service emails (for example the welcome email, plan confirmations and message notifications). It receives your email address and the content of the email.
- Telegram carries internal notifications to our team about new accounts, purchases, checkouts and store orders. These messages include your email address, what you bought or were buying, and the amount. Some notifications about the design assistant can include short fragments of a request.
- Cal.com handles bookings of an intro call from the Clothing Design Services page of the store, with the details you enter.
Cookies and Similar Technologies
The store (www.fupstudio.com) and the app (app.fupstudio.com) use the same cookie banner, and one choice covers both: it is saved for 12 months in a cookie called fup-consenso on fupstudio.com. You can change it at any time from Cookie settings in the store footer or Cookies in the app menu, or by deleting cookies in your browser.
- Necessary, always on: your sign-in session, your theme, your cookie choice and, in the store, Shopify's cookies for the cart, checkout and security.
- Understanding usage: Google Analytics, to see which pages and tools are used and where people get stuck.
- Screen recording: Microsoft Clarity, which records how pages are used, such as clicks, scrolling and what is shown on screen. Text typed into fields is masked, and we also hide email addresses and the assistant's notes.
- Advertising: tags from Google, Meta, TikTok, Pinterest and Microsoft Advertising, and Klaviyo's tracking in the store, which let these companies recognise you on other websites and tell us which ads work. In the app, the advertising tags are Meta and TikTok.
In the app, analytics, screen recording and advertising tools load only after you accept the matching category. In the store, your choice is passed to Shopify's consent system, which applies it to the store's apps; there, accepting either Understanding usage or Screen recording counts as consent to analytics.
When you buy a plan or credits in the app, our server reports the purchase (value, currency and plan) to Google Analytics, Meta and TikTok, linked only to the identifier that their tag previously stored in your browser; if that identifier is not there, nothing is sent. In the store, Shopify's Meta integration can also report purchases from Shopify's servers.
The app also counts page views with Vercel Web Analytics, which does not use cookies, and its sign-in page loads Google's sign-in script so that you can sign in with Google. The store loads fonts from Google Fonts.
Relationship with Shopify
Our store is hosted by Shopify, which collects and processes personal information about your access to and use of the store in order to provide and improve the store for you. Information you submit to the store will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the store for you. To learn more about how Shopify uses your personal information and any rights you may have, you can visit the Shopify Consumer Privacy Policy. Third Party Websites and Links
The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.
Children's Data
The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.
Security and Retention of Your Information
Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.
How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.
Specific periods:
- Your designs, uploads and tech packs: kept until you delete them or your account is deleted.
- The records of your generations, including the words of each request and the instruction written for the image engine: kept with your account, also after you delete the design.
- Design assistant readings: 30 days.
- The design assistant's notes: as described in "The Design Assistant's Memory".
- Your cookie choice: 12 months.
- Orders and invoices: kept for legal and accounting obligations.
- At our AI providers: as described in "AI Processing in the App".
You can request deletion of your account from Settings › Delete account in the app, or by email.
Your Rights and Choices
Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.
- Right to Access / Know. You may have a right to request access to personal information that we hold about you.
- Right to Delete. You may have a right to request that we delete personal information we maintain about you.
- Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
- Right of Portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
- Managing Communication Preferences. We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.
If you reside in the UK or European Economic Area, and subject to exceptions and limitations provided by local law, you may exercise the following rights in addition to the rights outlined above:
- Objection to Processing and Restriction of Processing: You may have the right to ask us to stop or restrict our processing of personal information for certain purposes.
- Withdrawal of Consent: Where we rely on consent to process your personal information, you have the right to withdraw this consent. If you withdraw your consent, this will not affect the lawfulness of any processing based on your consent before its withdrawal.
You may exercise any of these rights where indicated on the Services or by contacting us using the contact details provided below. To learn more about how Shopify uses your personal information and any rights you may have, including rights related to data processed by Shopify, you can visit privacy.shopify.com.
In the app you can also, from Settings, request deletion of your account and, when memory is available for your account, see, correct, download and delete the design assistant's notes and switch its memory off; you can change your cookie choices at any time.
We will not discriminate against you for exercising any of these rights. We may need to verify your identity before we can process your requests, as permitted or required under applicable law. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.
Complaints
If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you live, you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority. For the EEA, you can find a list of the responsible data protection supervisory authorities here. In Spain, where we are established, the authority is the Agencia Española de Protección de Datos (aepd.es).
International Transfers
Please note that we may transfer, store and process your personal information outside the country you live in.
The app runs on servers in Ireland and its database is hosted in Ireland. Some of our providers, such as OpenAI, Anthropic, Replicate, Stripe, Google, Meta, TikTok, Pinterest, Microsoft, Klaviyo, Resend and Telegram, may process your personal information in the United States or in other countries.
If we transfer your personal information out of the European Economic Area or the United Kingdom, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, update the "Last updated" date and provide notice as required by applicable law.
